Border submission packages may be prepared for persons who are travelling to Canada. These packages can be used for a variety of situations and are prepared for use upon entry to Canada. For example, during the COVID-19 pandemic border packages were prepared to assist a person in obtaining a travel or quarantine exemption upon entry. Odyssey Law can assist in preparing border submissions packages for various types of situations.

PR Card renewals can be done by permanent residents who are currently in Canada. To note, a person does not lose their permanent resident status when their PR card expires- an official process, for example, a hearing, must occur first.

To meet the residency requirements, a person must live in Canada for at least 730 days during the last five years. However, sometimes a person’s time outside of Canada can still count, for example, if they were living overseas with their spouse who is a Canadian citizen. Odyssey Law can conduct a PR Card Eligibility Assessment to determine whether a person meets the residency requirements.

If a person is outside of Canada without a valid PR card, they may need to apply for a permanent resident travel document (PRTD) to return to Canada.

If a person has lost their temporary status (visitor, worker or student) in Canada, they may be able to restore it. A person can submit a restoration application within 90 days of losing their status.  Importantly, once a person loses their status or fails to renew their status before it expires, even if they submit a restoration application they will not be able to benefit from the “maintained status” provisions of the Immigration and Refugee Protection Act (IRPA). This means they will not be able to continue working or studying while their application is processing. They will have to stop working or studying until they are issued a new permit.

When there is a question as to whether a person meets the criteria of the Immigration and Refugee Protection Act (IRPA) or Regulations (IRPR), an Officer may send an applicant what is called a Fairness Letter. A fairness letter should set out what the issue is, for example what section of IRPA or IRPR that the Officer thinks that the person may not meet, and give the applicant a chance to send in additional evidence or arguments in response. It is important to send in a fulsome response to a fairness letter as the immigration application at issue could face rejection.
