Citizenship Applications

Many individuals come to Canada with the ultimate goal of becoming Canadian citizens. At Odyssey Law, we are always excited to help clients attain this milestone, especially those who have been with us since the beginning of their journey to Canada. Eligibility for Canadian Citizenship

Canadian citizenship can be acquired either by birth or through the naturalization process.

1. Citizenship by Birth or Descent: If you were born in Canada or have at least one parent who is a Canadian citizen, you may already be a Canadian citizen. In such cases, you can apply for a Citizenship Certificate as proof of your status. 

2. Citizenship by Naturalization: If you are a permanent resident seeking to become a Canadian citizen, you must meet the following criteria:

  • Permanent Resident Status: You must hold permanent resident status in Canada.

  • Physical Presence: You must have been physically present in Canada for at least 1,095 days (3 years) within the 5 years immediately before your application.

  • Income Tax Filing: You may need to have filed personal income taxes for at least 3 years within the 5-year period.

  • Language Proficiency: If you are between 18 and 54 years old, you must demonstrate adequate knowledge of English or French.

  • Knowledge of Canada: You must pass a test on your rights, responsibilities, and knowledge of Canada.

  • Oath of Citizenship: You must be willing to take the Oath of Citizenship. 

Note: There are situations that can prevent you from becoming a Canadian citizen, such as unfulfilled conditions related to your permanent resident status or being under a removal order. 

Citizenship Certificate (Proof of Citizenship)

A Citizenship Certificate serves as official proof of Canadian citizenship. You may apply for a certificate if:

  • You were born outside Canada to a Canadian parent.

  • You need to replace a lost, stolen, or damaged certificate.

  • You require proof of citizenship for legal purposes.

Applications can be submitted online or on paper. Required documents include:

  • Proof of Parent’s Canadian Citizenship: Such as a citizenship certificate or Canadian birth certificate.

  • Applicant’s Birth Certificate: To establish the parent-child relationship.

  • Valid Identification: Two pieces, one of which must have a photo. 

Note: The citizenship certificate is not a travel document. To travel internationally, you must have a valid Canadian passport. 

Residence Questionnaire

If there are concerns regarding your physical presence in Canada, you may be asked to complete a Residence Questionnaire as part of your citizenship application. This questionnaire requires detailed information about your time spent inside and outside Canada during the relevant period.

Citizenship Ceremony

Upon approval of your citizenship application, you will be invited to attend a Citizenship Ceremony, where you will take the Oath of Citizenship. This ceremony marks the final step in becoming a Canadian citizen.
